When a contractor and its subcontractor each incur increased costs caused by the project owner, the contractor may employ a common settlement tactic with its sub. The contractor agrees to include the sub’s damages in the contractor’s claim against the owner and to pass through the appropriate share of any recovery to the sub.

Following on the heels of Wisconsin’s recent decision to integrate Building Information Modeling on state design and construction projects, Texas is now the second state to roll out mandatory BIM implementation. The Texas Facilities Commission (
TFC), which oversees the state’s real estate developments and facility operations, made the announcement in mid-August, with an addition announcement that it would release standardized requirements and guidelines in the near future.

Liquidated damages are stipulated in construction contracts in order to compensate the project owner for the contractor’s late completion of the work. The establishment of the daily rate can be somewhat murky and controversial. The legal standard, seldom applied in practice, is that the daily rate should be a reasonable forecast of the costs the owner will incur in the event of late completion of the project.

The $787 billion stimulus package has now been in play for almost six months. With the funds set to expire on Sept. 30, 2010, contractors are asking, “Where’s the money?” And just as importantly, they want to know how they can get a piece of the action. Sometimes in the heat of a disagreement, a contractor may indicate the contract is flawed and continued performance would be futile in the absence of a contract modification. This type of statement is dangerous, as it may later be interpreted as a repudiation of the contract. Anticipatory repudiation is a breach, justifying a termination for default by the project owner.
